Frequently asked questions
Haven’t found the answer? Give us a call – we provide information about notarial acts free of charge.
How do I book an appointment with the notary?
The simplest way is by telephone: +48 884 906 509 or +48 71 307 11 02, or by e-mail: kancelaria@ksnotariusz.pl. We will agree the type of act, the documents needed and the date.
My PESEL number is restricted. Can I sign the deed?
For many notarial acts – including property sales and mortgages – the notary checks whether the PESEL number is restricted. You need to lift the restriction before your visit: in the mObywatel app, on gov.pl (trusted profile, e-ID card, online banking) or in person at any municipal office. It can be lifted temporarily – until a chosen date and time, after which the number is automatically restricted again. Details.
Can I choose any notary?
Yes. The parties may choose any notary in Poland, regardless of where the property is located or where they live.
How long does it take to prepare a notarial deed?
It depends on the type of act and whether the documents are complete. Simple acts, such as a power of attorney or signature certification, are often performed on the day of the request. For a sale agreement, we usually prepare the draft deed within a few days of receiving the documents.
Can I see the draft deed before signing?
Yes. We send the draft deed to the parties by e-mail before the appointment, so that you can read it carefully.
Who pays for the notarial deed?
The parties decide how costs are shared. In a property sale, the buyer customarily bears the costs, but other arrangements are possible – for example, splitting them equally.
How can I pay?
In cash at the office or by bank transfer to the office’s bank account – details on the Fees page.
What is a certified copy (wypis) of a notarial deed?
The original deed (minuta) remains at the office. The parties receive certified copies (wypisy), which have the legal force of the original. If needed, a further copy can be ordered from the office, even years later.
Can the notary come to my home, a hospital or a care home?
Yes, where the nature of the act or special circumstances justify it. Please telephone to arrange a date.
I cannot attend in person. What can I do?
You can grant a power of attorney to another person. For the sale or gift of real property, the power of attorney must be made in the form of a notarial deed – it can be executed before any notary and, abroad, also at a Polish consulate.
I do not speak Polish. Can I sign a notarial deed?
Yes. The office also serves clients in English. If a party does not speak Polish, the deed is executed with the participation of a sworn translator (tłumacz przysięgły), who translates its content. We can help arrange a translator, including for Ukrainian.
Why does the notary ask about the source of funds?
A notary is an obliged institution within the meaning of the Act on Counteracting Money Laundering and Terrorist Financing. For certain acts, the notary must identify the parties, establish the beneficial owner and – where necessary – the source of the funds.
Will the notary file the application with the land and mortgage register?
Yes. After signing a deed that requires an entry, the notary files the land register application electronically and collects the court fee. You do not need to visit the court yourself.
