Powers of attorney and certifications
Quick notarial acts that can often be performed on the same day. Please telephone in advance.
Notarial power of attorney
If you cannot attend the notary in person – for example when selling a flat – you can grant a power of attorney to another person. For acts that require the form of a notarial deed (sale or gift of real property), the power of attorney must also be made as a notarial deed. General powers of attorney, or those for banking or administrative matters, may be made in writing with a notarially certified signature.
You will need: the identity document of the principal, the details of the attorney (first name, surname, PESEL number, address) and a description of the matters covered by the authorisation – for real property, also the land and mortgage register number.
Signature certification
The notary certifies that a signature was made in their presence or acknowledged as one’s own. Please bring the unsigned document and your identity document. The notary does not assess the content of the document but may refuse certification if the document is contrary to law.
Certification of a copy as a true copy of the original
We certify that a copy, duplicate or extract conforms to the document presented – for example a diploma, a certificate or a document for an authority abroad.
Declaration of submission to enforcement – occasional lease
For an occasional or institutional lease agreement, the tenant makes a declaration in the form of a notarial deed submitting to enforcement and undertaking to vacate the premises. You will need: the tenant’s identity document, the lease agreement or its draft, and the address of the premises to which the tenant could move.
A declaration of submission to enforcement regarding payment of a sum of money or surrender of property is also used to secure loan agreements, sale agreements with deferred payment and leases of commercial premises.
Certain date, deposit, protests of bills of exchange
The notary certifies the date on which a document was presented (certain date), accepts money, documents and securities into deposit – for example to settle the sale price securely – and draws up protests of bills of exchange.
